DIGITAL DOWNLOAD TERMS & LICENSE AGREEMENT

Kay’s Klassy Connections LLC
Effective Date: January 2025

These Digital Download Terms (“Terms”) govern your purchase and use of any digital products, artwork, illustrations, templates, patterns, or files (“Digital Products”) sold or distributed by Kay’s Klassy Connections LLC (“Company,” “We,” “Us,” or “Our”).
By purchasing, downloading, accessing, or using any Digital Product, you agree to these Terms.

1. LICENSE GRANTED (WHAT YOU CAN DO)

When you purchase a digital product from Kay’s Klassy Connections LLC, you receive a single, personal-use-only license.

This means you may:

✔ Download the file for your own personal use
✔ Print it for your own home, gifts, or personal projects
✔ Keep it on your devices for your own enjoyment
✔ Use it in your personal journal, planner, or home decor
✔ Use it for vision boards or mood boards

This license is non-transferable, non-exclusive, and personal-use only.

2. PROHIBITED USE (WHAT YOU CANNOT DO)

By purchasing or downloading any digital product, you AGREE NOT TO:

❌ Commercial Use

You may NOT:

  • Sell products that include our designs

  • Print our designs and sell them

  • Upload our art to POD services
    (Printify, Redbubble, Teespring, Zazzle, Shopify, Amazon, etc.)

  • Use the artwork for branding or logos

  • Create merchandise (shirts, stickers, mugs, etc.)

  • Use our digital files for business use unless a separate commercial license is purchased

❌ Redistribution

You may NOT:

  • Share the files with friends, family, or online groups

  • Email, upload, or distribute the files

  • Sell or give away the digital files

  • Post the files on Pinterest, Facebook, Instagram, Etsy, or any platform

  • Upload the files to any “freebie” or “download” website

  • Share in Discord groups or student groups

  • Include files in bundles or downloads

❌ Modification or Derivatives

You may NOT:

  • Edit, recolor, redraw, or trace the artwork

  • Remove watermarks or copyright notices

  • Use parts of the artwork to create new designs

  • Turn the artwork into SVGs, clipart, cut files, or digital assets

  • Convert our PNGs/JPGs into stickers to sell

  • Use our patterns to create your own versions

❌ AI Training or AI Reproduction

You may NOT:

  • Upload our art into ANY AI tool
    (Midjourney, Stable Diffusion, DALL·E, Canva AI, Kittl AI, Fotor, etc.)

  • Use our artwork as AI prompts

  • Train AI models using our characters

  • Ask AI to “remake” our designs or characters

  • Use AI to create derivative artwork inspired by our files

ANY AI-related misuse is considered copyright infringement.

3. COPYRIGHT & OWNERSHIP

All copyrights, intellectual property rights, characters, designs, art styles, patterns, graphics, and digital products remain the exclusive property of Kay’s Klassy Connections LLC.

You receive a license, not ownership.

We retain full legal rights to:

✔ Our characters
✔ Our storylines
✔ Our designs
✔ All original illustrations
✔ Patterns and layouts
✔ Color schemes and concepts
✔ All digital and physical products

Unauthorized use will result in immediate DMCA takedown and legal action.

4. NO REFUNDS ON DIGITAL PRODUCTS

Because digital items are delivered instantly and cannot be returned, all digital sales are final.

No refunds will be issued for:

  • Accidental purchases

  • Incompatibility with your device

  • Not reading the description

  • Download issues (unless proven on our end)

If you have technical trouble, contact us at info@kaysklassyconnections.com and we’ll help.

5. DELIVERY OF DIGITAL PRODUCTS

After purchase, your files will be:

✔ Immediately available for download
✔ Delivered via email (if applicable)
✔ Accessible through your Shopify account (if enabled)

You are responsible for downloading and backing up your files.

We do not guarantee file access if you lose your download link in the future.

6. ENFORCEMENT & DMCA POLICY

If you violate these Terms, we reserve the right to:

  • Issue DMCA takedown notices

  • File copyright claims

  • Pursue damages

  • Block your access

  • Cancel your license

  • Notify platforms (Shopify, Etsy, Printify, Pinterest, TikTok, Instagram, Facebook, Amazon, etc.)

We actively protect our art and designs to safeguard Black creators, anime artists, and original content.

7. LIABILITY LIMITATION

We are not responsible for:

  • Device compatibility

  • Loss of files after download

  • Delayed email delivery

  • User misuse or lack of understanding

  • Any damages arising from file usage

You agree to use digital products at your own discretion.

8. CHANGES TO THESE TERMS

We may update these Terms at any time. Updates go into effect immediately once posted on this page.
